• Innocent Spouse

Taxpayers often find themselves in trouble with the IRS not because of any fault of their own, but because of their spouse’s or Ex-spouse’s actions. The IRS realizes that some spouses are innocent and the IRS is willing to work with us in these situations.

By filing joint tax returns, couples assure the IRS that they will be jointly and severally liable (meaning both parties owe and if the IRS cannot collect against one spouse, they can just as easily come after the other spouse) individually and collectively are held responsible for taxes and interest owed to the IRS. It doesn’t even matter that at the time of filing only one taxpayer is earning an income.

In order to help taxpayers that are being subjected to IRS problems because of their spouse’s actions, the IRS has come up with guidelines to qualify a person as an innocent spouse who then does not have to pay on your spouse’s or ex spouse’s IRS debts.

Before submitting the tax return to the IRS, both taxpayers must carefully review it. Sometimes, taking necessary measures before submitting tax returns to the IRS can lower the possibility of having errors on the return and eliminate the need for tax resolution services.  Oftentimes, your tax preparer or CPA does not counsel you as the benefits or advantages that may exist if a couple were to file separately.  The benefits lie in tax relief and lowering your tax liability.  Many married couples don’t even realize that they can file separately.  We can help you with this by taking a look at your situation before you file, so you don’t later need our services for IRS Tax Dispute Resolution.
It is important to sign up for this relief program within the two year period after IRS has notified you for collection of taxes.

There are generally three types of spousal relief:

    • Classic Innocent Spouse Relief
    • Separate Liability Election
    • Equitable Relief

After reviewing all the documents, the IRS will decide whether the person is innocent or not.  If your documents show that you are innocent of the tax liability, it makes you eligible for their innocent spouse relief program and the IRS may lift all the penalties and taxes which they determine you are not liable for.  The IRS may also provide you with partial tax relief that you owe. A tax resolution professional can help expedite the process and ensure it is properly handled.
